Debt Claims in Sweden: Betalningsföreläggande, Kronofogden and Service of Documents

If someone in Sweden owes you money, you have a fast administrative route that most foreign creditors do not know about. Sweden's Enforcement Authority, Kronofogdemyndigheten, handles a summary procedure called betalningsföreläggande (order to pay) that produces an enforceable decision without a court trial. Service of documents is a central part of it, and it is where foreign creditors most often lose time.

The critical dependency is service. Kronofogden cannot issue an utslag until the debtor has been properly served, and its own service attempts can stall for months. A creditor who arranges private authorised service usually shortens the whole procedure dramatically.

Step 1: the demand letter

A written demand is not formally required for betalningsföreläggande, but it is worth sending, for three reasons: many debtors simply pay, it starts a documented record, and Kronofogden's costs regime rewards a creditor who behaved reasonably.

A registered letter with signature confirmation is the standard tool here, at $65, with an outcome in about two to three weeks. If the letter is collected and the debt is not paid, you have both the evidence and the answer.

Step 2: the application

The application to Kronofogden must identify the creditor, the debtor, the amount claimed, interest, costs, and the ground for the claim. It does not require evidence at this stage. The application fee is modest and recoverable, and a small statutory amount can be claimed for your own work on the case.

A foreign creditor can apply. You do not need a Swedish lawyer, but you do need a Swedish address for service of the authority's own documents or an agent who can receive them.

Step 3: service of the application on the debtor

Kronofogden must serve the application. It first uses ordinary postal service. If the debtor does not return the acknowledgment, the case waits. This is where months disappear.

A creditor may arrange service through an authorised process server (stämningsman) instead, which is faster and uses the full escalation ladder in Delgivningslagen: personal delivery, substitute service on an adult household member or the employer, and spikning at the residence where evasion is documented. The completed report goes to Kronofogden and the ten-day objection period starts running.

Step 4: utslag and enforcement

If the debtor does not object within the deadline, Kronofogden issues an utslag. It is directly enforceable, and the authority can move to attachment of wages (löneutmätning) or of assets. A registered utslag also affects the debtor's credit record, which is itself a powerful motivator for payment.

If the debtor objects, the summary procedure ends. You then choose whether to have the matter referred to the district court, where the ordinary rules apply and service is again a live issue for any subsequent documents.

For EU creditors there is also the European Order for Payment under Regulation (EC) 1896/2006, which is a parallel route to a Swedish betalningsföreläggande. It is useful for uncontested cross-border claims, but it carries its own service requirements and is not always faster than the domestic route with private service.

When to skip the summary procedure

  • The debt is genuinely disputed on the merits. An objection is near certain, so a district court claim is the honest starting point.
  • The debtor is insolvent and there is nothing to attach. Verify before spending on process.
  • The claim is not for a defined sum of money. Betalningsföreläggande is only for quantified claims and certain possessory matters.

Can a foreign company apply for betalningsföreläggande? Yes. The procedure is open to foreign creditors, and the application can be made in Swedish with the supporting details you supply.

How long does the whole process take? With cooperative service, roughly six to ten weeks from application to utslag. With Kronofogden's postal service against an evasive debtor, several months longer.

Does an utslag work like a court judgment? For enforcement inside Sweden, yes. For enforcement abroad, treat it as a title that may need recognition under the applicable regulation or convention.

Can I claim my costs? A statutory application fee and a modest fixed amount for your own work are claimable. Private service costs are not automatically reimbursed in full, so weigh them against the time saved.

Is a debt collection agency required? No. You can apply directly, and you can instruct an authorised process server directly.
